Mr. Metcalf has significant experience and expertise in handling corporate, commercial, and business litigation for small businesses, Fortune 500 corporations and all types of corporate and commercial entities. 

Mr. Metcalf has additional, far-ranging experience in the litigation and resolution of all manner of tort and contract-based claims against his clients including: business torts, breach of contract, tortious interference with contract, commercial fraud, breach of fiduciary duty, antitrust, corporate and shareholder disputes, intellectual property, unfair competition, partnership disputes, and real estate.

Mr. Metcalf's Representative Cases and Experience:
  • Represented generic pharmaceutical manufacturer in $18 million breach of contract, tortious interference, and antitrust action against supplier of critical ingredient utilized in line of cold products and branded Rx competitor.  Result: favorable settlement on eve of trial.
  • Defended foreign technology company in $53 million breach of contract and breach of warranty action filed by telecommunications provider.  Presented plaintiff’s case at two-day mock trial. Co-counsel during five-week trial.    Result: favorable settlement for client during client’s case-in-chief.
  • Represented fax distributor and subsidiaries in breach of contract and breach of warranty action against foreign manufacturer. Led team of associates and paraprofessionals. Conducted multi-week deposition program in South Korea.  Co-counsel for three-week trial. Result: clients awarded $10.3 million.  
  • Defended clearing firm in NYSE arbitration involving claims of $25 million arising out of purchases of collateralized mortgage obligations.  Co-counsel for twenty-day arbitration.  Result: panel awarded claimants zero.  
  • Represented California businesses in breach of warranty, breach of contract, and fraud action against manufacturer of computer systems.  Multi-week deposition program in California.  Result: clients awarded in excess of $1 million.
  • Defended Canadian subsidiary of U.S. accounting firm in securities class action with $50 million in damages arising out of fraudulent inventory of a Canadian gold mining company. Result: favorable settlement for client.

                    <li>Conducted three-day bench trial for insurer involving the interpretation and scope of a release.</li>
